Miniature and Toy Australian Shepherd Sales Contract

Payment in the amount of $ _______________ is acknowledge as received. If the amount given is a deposit, paritial or down payment, the sum of $_________ is due and payable before transfer of the dog.  Buyer is responsible for paying full shipping costs, including appropriate sized crate.

Payment method:

1.  By check.  This must be paid at least 10 days prior to transfer of said dog/puppy to clear bank.

2. By money order or certifified check sent by overnight mail.

3. By Paypal. Add 6% of total cost of dog plus shipping cost.

Registration application with American Stock Dog Registry is included as part of the agreement, and will be provided to the buyer upon full payment of the dog.  Seller will provide up-to-date health record information to Buyer at time of transfer of dog.  Seller guarantee's dog to be sound and free of diseases at time of transfer of said dog to Buyer for a period of 72 hours.  Buyer agrees to have said puppy examined by a licensed small animal veterinarian within 72 hours of receipt of said puppy (Excluding weekends). If said puppy is found to be in poor health during this time period, as evidenced by a signed, written report by a licensed veterinarian, Buyer will have the option to return the Puppy at Sellers expense for a replacement as soon as a puppy becomes available.   If Buyer decides to keep said dog, they will assume all expenses involved with said dog care.

Breeder will replace (of equal value) with a signed statement from a licensed veterinarian for the following genetic defects:

1. Failure to receive a passing rating on hips from the Orthopedic Foundation for Animals.

2. Failure to receive a normal reading from Canine Eye Registration Foundation.

3. Additional debilitating conditions due to genetic health problems must be discovered within 12 months of birth of said dog.  Reports must be submitted by two different veterinarians at two different clinics certifying that said dog is suffering from one of the following: Thyroid, epilepsy, immune suppression.  At that time.  Buyer can keep said dog and receive a replacement dog of equal value.  UNDER NO CIRCUMSTANCES WILL FULL REFUND BE MADE,  If Buyer chooses euthanasia for said dog, a written statement from the attending veterinarian, stating reason and date he performed the procedure.  Expenses for euthanasia will be the responsibility of the Buyer.  Upon receipt of veterinarians statement, Buyer may choose a replacement puppy of same sex and similar value, to be shipped at Buyer's expense.

This warranty does not cover deformation or abnormalities caused by injury, neglect, or environmental conditions.  This warranty does not cover veterinary bills or transportation costs incurred for this dog.  Said expenses are the responsibility of the Buyer.

This dog is being sold as a companion animal/pet quality only.  Although the dog may be capable of performing other functions, no warranty is given for it's fitness for a particular use. 

Although we do our best to estimate the height of the puppy at maturity, we cannot guarantee the actual size at maturity. Minis and Toys have standard sized Austrlian Shepherds in their background to recessive genes occasionally come out.

If at anytime, the Buyer is unable or chooses not keep the puppy, please contact us.  We will be happy to help place the dog into a good home or will take it back to our kennel with shipping costs paid by Buyer.  No refund of money or replacement will be given under these circumstances.  At no time should you take your dog to an animal shelter or research faciltiy.  The Buyer agrees that this contract is non-transferable.

Although there are no plans at present to stop breeding Miniature/Toy Australian Shepherds, the above guarantees are valid only so long as Breeder is breeding said dogs.  Should Breeder cease breeding said dogs, for any reason, this Slaes Contract will become null and void.  In the event of a disput, the state of Nebraska will have jurisdication over this matter.

The Buyer has read and understands the foregoing and agrees that all parts of this contract are a binding agreement with the Seller.  If either the Buyer or the Seller takes legal action regarding this contract, action will be iniated in the county of the Seller's residence and legal fees and court costs shall be the responsibility of the party found at fault.

Shipping fee costs will be determined at time of booking according to method required.   Costs include shipping, crate, health certificate, additional shots needed and transportation to point of pick-up.  Usually the cost is around $350.00 to $500.00 and this depends on the place of shipment to. This fee is the buyers responsiblity and is to be paid before the puppy is shipped to his or her new home.
